# TERMS & CONDITIONS
## ARTICLE 1 – Definitions
In these Terms and Conditions, the following definitions apply:
**Entrepreneur:** the natural or legal person offering products and/or services to consumers at a distance.
**Consumer:** the natural person acting outside the scope of a profession or business who enters into a distance contract with the Entrepreneur.
**Distance Contract:** a contract concluded between the Entrepreneur and the Consumer within the framework of an organized system for distance sales without the simultaneous physical presence of both parties, using one or more means of distance communication.
**Means of Distance Communication:** any means that can be used to conclude a contract without the Consumer and Entrepreneur being physically present together.
**Cooling-off Period:** the period during which the Consumer may exercise the right of withdrawal.
**Right of Withdrawal:** the Consumer’s right to cancel the distance contract within the cooling-off period.
**Day:** calendar day.
**Durable Medium:** any instrument enabling the Consumer or Entrepreneur to store information addressed personally to them in a way accessible for future reference and unchanged reproduction.

## ARTICLE 3 – Applicability
1. These Terms and Conditions apply to every offer made by the Entrepreneur and to every distance contract concluded between the Entrepreneur and the Consumer.
2. Before concluding a distance contract, the text of these Terms and Conditions shall be made available to the Consumer electronically or otherwise in such a way that it can be stored on a durable medium.
3. If specific product or service conditions apply in addition to these Terms and Conditions, the Consumer may always invoke the provision most favorable to them in the event of conflicting terms.

## ARTICLE 4 – The Offer
1. If an offer has a limited validity period or is subject to conditions, this shall be explicitly stated.
2. The offer contains a complete and accurate description of the products and/or services offered. Product descriptions and images are provided as accurately as possible. Minor differences in color, dimensions, wear, or finish are possible, especially with vintage and pre-owned items.
3. Obvious mistakes, typographical errors, or pricing errors are not binding on the Entrepreneur.
4. All prices stated include VAT unless otherwise indicated.

## ARTICLE 5 – The Contract
1. The contract is concluded when the Consumer accepts the offer and complies with the stated conditions.
2. Orders placed electronically will be confirmed by email as soon as possible.
3. The Entrepreneur reserves the right to refuse or cancel orders in cases of incorrect pricing, suspected fraud, unavailable products, or other reasonable grounds.
4. The Entrepreneur shall take appropriate technical and organizational measures to secure electronic transactions and personal data.

## ARTICLE 6 – Right of Withdrawal
1. The Consumer has the right to withdraw from the contract within 14 days after receiving the product, without giving any reason.
2. During the cooling-off period, the Consumer shall handle the product and packaging with care and may only inspect the product as necessary to determine its nature and characteristics.
3. To exercise the right of withdrawal, the Consumer must notify the Entrepreneur by email within the cooling-off period.
4. Returned products must be sent back complete, unused where reasonably possible, and in the original packaging.
5. The right of withdrawal does not apply to:
* custom-made or personalized products;
* products that cannot reasonably be returned due to their nature;
* business-to-business sales.

## ARTICLE 7 – Costs in Case of Withdrawal
1. The direct costs of returning the product are borne by the Consumer unless agreed otherwise.
2. The Entrepreneur shall reimburse all payments received from the Consumer, including standard delivery costs, within 14 days after receiving the returned goods or proof of return shipment.
3. Refunds will be made using the same payment method used by the Consumer unless otherwise agreed.

## ARTICLE 8 – Delivery and Shipping
1. The Entrepreneur shall process orders with reasonable care and dispatch products within the indicated delivery timeframe.
2. Delivery times are estimates and not strict deadlines.
3. The risk of loss or damage passes to the Consumer once the product has been delivered.
4. All shipments are insured where applicable.
5. Upon delivery, the Consumer is advised to inspect the package and product immediately.
6. Any visible transport damage or missing items must be reported to the carrier and to the Entrepreneur within 48 hours after delivery.

## ARTICLE 9 – Vintage and Pre-Owned Items
1. The Entrepreneur specializes in vintage, design, and pre-owned furniture and objects.
2. Due to the nature of vintage products, signs of age, wear, restoration, repairs, discoloration, or imperfections may be present and are considered part of the character of the item.
3. Product descriptions and photographs aim to provide an accurate representation of the condition of each item.
4. Minor deviations in dimensions, colors, or condition do not constitute grounds for cancellation or compensation.

## ARTICLE 10 – Prices and Payment
1. All prices are stated in Euros (€) and include VAT unless otherwise specified.
2. Payment must be completed using the payment methods offered on the website.
3. The Entrepreneur reserves the right to change prices at any time before a contract is concluded.
4. Orders may be cancelled if payment is not completed within the specified timeframe.

## ARTICLE 11 – Complaints
1. Complaints regarding products or services must be submitted by email within a reasonable period after discovery of the issue.
2. Complaints should include:
* a description of the issue;
* photographs where applicable;
* the order or invoice number.
3. The Entrepreneur shall respond within 14 days after receipt of the complaint.

## ARTICLE 12 – Liability
1. The Entrepreneur’s liability is limited to the invoice amount of the relevant order unless mandatory law provides otherwise.
2. The Entrepreneur is not liable for indirect damages, consequential damages, loss of profit, or damages resulting from improper use of products.
3. Nothing in these Terms excludes liability where exclusion is prohibited by law.

## ARTICLE 13 – Privacy
The Entrepreneur processes personal data in accordance with applicable privacy legislation and the website’s Privacy Policy.

## ARTICLE 14 – Applicable Law and Disputes
1. These Terms and Conditions and all agreements between the Entrepreneur and the Consumer are governed exclusively by Dutch law.
2. Any disputes shall be submitted to the competent court in the Netherlands.
